Terms of Service

Welcome to AIrtive (the “Service”), an AI media creation application operated by Tokuyosi LLC (“we,” “us,” or “our”). These Terms of Service (the “Terms”) form a binding agreement between you and us governing your access to and use of the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
The Service is available only to individuals who are at least 18 years of age and legally able to enter into a binding contract. By using the Service you represent and warrant that you meet these requirements. We do not knowingly permit access by anyone under 18.
2. The Service
AIrtive lets adults create images, videos, transformations, and other media from templates, prompts, and uploaded reference materials. The Service does not permit sexual content involving minors, non-consensual intimate imagery, or unlawful impersonation.
3. Acceptable Use
You agree not to:
- Upload, request, or attempt to generate sexual content involving a minor, non-consensual intimate imagery (NCII), or any depiction intended to impersonate or sexualize a real identifiable person;
- Use the Service to harass, defame, stalk, threaten, or defraud any person, or to promote violence, terrorism, self-harm, or discrimination;
- Infringe any intellectual property, privacy, publicity, or contractual right of any third party;
- Spread disinformation, especially about elections, public-health matters, or judicial proceedings;
- Reverse engineer, scrape, or otherwise extract data from the Service except as expressly permitted by us in writing;
- Resell, sublicense, or commercially exploit access to the Service, including by reselling credits or subscriptions;
- Bypass content filters, abuse rate limits, or use the Service via automated means (bots, scripts) without our written consent;
- Use the Service in any jurisdiction or for any purpose that is unlawful under applicable law.
We may suspend or terminate access for any violation of these Terms or our Content Policy, at our sole discretion and without prior notice.
4. Accounts
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We may suspend or close accounts that we reasonably believe are involved in violations of these Terms.
5. Subscriptions, Credits, and Payment
Some features require payment. We offer recurring subscriptions (“Pro” plans) and one-time credit packs, processed through Stripe.
- Subscriptions auto-renew at the end of each billing period until canceled. You may cancel at any time from the in-app billing portal; cancellation takes effect at the end of the current period.
- Credits are a usage unit redeemable only inside the Service. They are not currency, hold no monetary value, and may not be transferred, resold, or refunded for cash.
- Prices are shown and charged in U.S. dollars, exclusive of tax; consumption tax or VAT for your location is added at checkout. Your card issuer may apply its own currency-conversion fee.

6. User Content
Prompts and any text, image, video, or audio inputs you provide are your “User Content.” You retain ownership of your User Content. You grant us a worldwide, royalty-free, non-exclusive license to host, store, transmit, and process your User Content solely to operate, secure, and improve the Service. We do not sell your User Content to third parties.
7. AI-Generated Output
- We do not claim ownership of the images, videos, and audio you generate with the Service. Subject to these Terms and to your account being in good standing, you may use, publish, and monetize your output, including for commercial purposes and including sponsored or advertising content.
- Images, videos, audio, and other outputs are generated by machine learning models. They may be inaccurate, inconsistent, or unsuitable for any specific purpose, and they are provided “as is” with no warranty of fitness for a particular use.
- The Service does not provide medical, legal, financial, psychological, or other professional advice.
- Outputs may not be unique; similar outputs may be produced for other users. You should not assume exclusive rights to any generated content, and you may not claim that output generated by the Service is exclusively yours.
- You are responsible for the rights in what you put in. You may only generate from material you own or are authorized to use, and you must clear any rights in a person’s likeness, in music, and in third-party trademarks before publishing output commercially. Some jurisdictions also require AI-generated media to be disclosed as such.
- Commercial use remains subject to our Content Policy. Output generated from Spicy templates, and any other adult content, may not be used in advertising or in any context presented to minors.
8. Intellectual Property
The Service, including the AIrtive name, logo, templates, sample media, software, and all related materials, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal or commercial purposes, subject to these Terms. This license covers your use of the Service and the output you generate with it; it does not permit you to resell or sublicense access to the Service itself, or to redistribute our templates, sample media, or software as your own. All rights not expressly granted are reserved.
9. Copyright (DMCA)
We respect intellectual property rights and respond to claims of copyright infringement under the Digital Millennium Copyright Act. See our DMCA Policy for details and the designated agent.
10. Privacy
Our handling of personal information is described in the Privacy Policy. By using the Service you consent to the practices described there.
11. Termination
You may stop using the Service at any time and may delete your account from the in-app settings. We may suspend or terminate your access with or without notice if we believe you have violated these Terms, our policies, or applicable law, or if we discontinue the Service. Provisions of these Terms that by their nature should survive (including Sections 6–8, 12–15) will survive termination.
12. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (ii) USD $100.
This section does not exclude our liability for willful misconduct or gross negligence, and does not apply to the extent it is void under mandatory consumer-protection law that applies to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in San Francisco, California. Each party waives any right to participate in a class action or representative proceeding. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in court to protect its intellectual property rights.
Consumers: if you use the Service as a consumer, the choice of law above does not deprive you of the protection of mandatory consumer-protection rules of the country where you habitually reside, and nothing in this section limits any right you have to bring proceedings in the courts of that country.
16. Export Compliance
You agree to comply with all applicable U.S. and international export-control and sanctions laws. You represent that you are not located in, and will not use the Service from, a country subject to a U.S. embargo, and that you are not listed on any U.S. government sanctions list.
17. Changes
We may revise these Terms from time to time. Material changes will be posted on this page with a revised “Last updated” date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
